On 1 November 2009, CIT Group Inc. filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code. The petitions were filed in the US Bankruptcy Court for the Southern District of New York. Such action qualified as Bankruptcy according to the definitions and provisions contained in Section 4.2 of the 2003 ISDA Credit Derivatives Definitions published by the International Swaps and Derivatives Association (“ISDA”). The Credit Event will affect the Outstanding Principal Amount of the Class D Notes II. This credit event notification is effective on 4 November 2009.
