Pomerantz Firm Charges Washington Mutual Bank With Overtime Violations


NEW YORK, Dec. 11, 2009 (GLOBE NEWSWIRE) -- Pomerantz, Haudek, Grossman & Gross LLP ("Pomerantz") has filed an action against Washington Mutual Bank ("WaMu") alleging violations of federal and NY state labor laws concerning the payment of overtime compensation. The complaint also names JP Morgan Chase & Co. and JPMorgan Chase, NA (together, "JPMorgan Chase"), as a defendant in its capacity as the successor to WaMu's liability for the alleged misconduct.

The complaint alleges that WaMu failed to pay all overtime compensation due to plaintiffs that worked in excess of forty hours per work week. The federal claims, alleged under the Fair Labor Standards Act, are brought on a nationwide basis on behalf of a Collective Class of all non-exempt loan operations and/or loan fulfillment personnel at WaMu, including loan processors, underwriters, closing coordinators and all other back office staff involved in the processing of WaMu loan applications in the past three (3) years. The state claims are alleged on behalf of all individuals who were employed by WaMu in the State of New York in the past six (6) years in any of the positions described above.
