Affitech Issues Update on Litigation

Release No 37/2009

Affitech Issues Update on Litigation

Copenhagen and Oslo, December 17th, 2009
Affitech A/S, (Nasdaq OMX: AFFI), the antibody medicines company, today
announced that the ongoing litigation with a minority group of shareholders has
been returned to the Lyngby court with a finding in favour of the litigants.
This finding was reached on a technical matter - the late filing of Affitech's
response - and not on a consideration of the merits of the litigants' claims or
the Company's response to them. The Company expects Affitech's response to now
be considered by the Lyngby court. As stated previously in the Company's June
30th prospectus document, Affitech and its advisors continue to believe that
there is no legal basis for the objections filed in the minority shareholders'
writ and the Company intends to defend its position vigorously.
