SEATTLE, April 30, 2010 (GLOBE NEWSWIRE) -- Keller Rohrback L.L.P. is pleased to announce that attorneys Derek Loeser and Ben Gould have been chosen to receive a Burton Award for Legal Achievement for their article: "The Continuing Applicability of Rule 23(b)(1) to ERISA Actions for Breach of Fiduciary Duty," published in Pension & Benefits Daily on August 31, 2009. The article was among 30 selected winners chosen from 1,000 submissions from the nation's largest and most prestigious law firms.
The article examines the Supreme Court decision LaRue v. DeWolff, Boberg & Assocs., Inc., and concludes that the decision supports Rule 23(b)(1) class certification of ERISA breach of fiduciary duty cases brought by plan participants on behalf of retirement plans. "We strive to present complex legal issues clearly and persuasively, and we are honored to receive this distinguished award," said Mr. Loeser.
The Burton Awards program, which recognizes the nation's finest legal writers, is run in association with the Library of Congress Law Library. The entries are judged by a committee of prominent active judges and professors from premier US law schools.
The Eleventh Anniversary Burton Awards event will be held at the Library of Congress on June 14, 2010. The guest speakers this year include Supreme Court Justice Ruth Bader Ginsburg; Author Bryan Garner; and senior analyst for CNN Worldwide and author of The Nine: Inside the Secret World of the Supreme Court, Jeffrey Toobin. Political commentator Bill Press will be the Master of Ceremonies. Additional information about the awards and event can be found at www.burtonawards.com.
