Showdown in Federal Court As Billionaire Media Mogul Alki David Leads The Artists for Justice To Possible Victory
BEVERLY HILLS, Calif., July 2, 2012 (GLOBE NEWSWIRE) --
Updated Information:
A hearing is scheduled for Monday July 2, 2012 in Courtroom 840 at 1:30 pm at the Los Angeles Edward R. Roybal Federal Courthouse.
The address to this courthouse is:
Edward R. Roybal Federal Building & U.S. Courthouse
255 E Temple St, Los Angeles 90012; (213) 894-1565 or 2215
Judge Dale S. Fischer will preside. CBS lawyers have made a motion to dismiss the case.
"This is a momentous decision for Artists and owners of intellectual property The World over. If Judge Fischer finds that the motion to dismiss is not granted, the number of copyrights in the case creates a huge threat to CNET and opens the door to more litigation against CNET and ultimately its parent company, Viacom (VIA). Copyright infringement of this kind not only passes responsibility to parent companies but also officers and shareholders such as Sumner Redstone, Les Moonves and Jarl Mohn are personally liable," said David.
The media is invited to participate and Alki David will be available for comments and interviews after the decision.
In 2011 Billionaire Media Mogul Alki David, founder of FilmOn.TV, the live streaming Platform, reigned in his controversial lawsuit against CBS Interactive, then re-filed again in May of 2011 with a coalition of over one hundred Artists and Copyright holders; turning contentious issue into a monumental movement.
The lawsuit claims damages from over one thousand copyrighted works pirated by millions of online users who were induced and indoctrinated by CNET/Download.com staff in a culture that fostered online piracy.
Jamie Marquart, of the law firm Baker Marquart, representing Alki David and The Artists For Justice Coalition, stated that "the recent quotes from the RIAA and recent legal precedent are finally catching up to the reality of the market. Those that promote and disseminate the tools of infringement are the guiltiest of all."
Alki David added "our arguments show that time after time CNET reporters and commentators promoted and endorsed the use of known pirating tools such as Limewire, Frostwire, Bittorrent and many others. Furthermore we will show how CNET actually hosted embedded links directly from their web pages to download thousands upon thousands of songs from artists such as Snooop Dogg, Brittney Spears and many many more."
On Monday, July 2, 2012, there will be a Federal Court hearing in Los Angeles requested by CBS lawyers to have the case of Alki David et al vs. CBS Interactive/CNET dismissed. However Mr. David is very confident in the case and that it cannot be ignored, stating that "we have heaps of video and recorded evidence showing that CNET reporters and editors induced millions upon millions of online users to pirate known copyrighted works, so much of which belong to our coalition, including myself."
Other known facts:
From the many billions of known pirating tools downloaded at CNET/Download.com, including Frostwire, Mp3Rockets, Bittorrent and others, Federal Judge Kimba Wood (who in 2010 shuttered limewire.com) was shown evidence in the Lime Wire trial that CNET/Download.com was the exclusive distributor of Lime Wire from which users who were directed to download over One Billion copies of Lime Wire.
During that same trial, CNET co-founder and then CEO, Shelby Bonnie, was a sitting board member on Warner Music Group whilst Warner Music was suing Limewire.
"Unlike upstarts like Barry Diller's Aereo, who seek to not pay for Network content by assuming preposterous technical loopholes, FilmOn has always maintained its position as a Virtual Cable System and that it wishes to pay industry standard residuals (MFNs) based on Subscriber numbers to the FilmOn service."
"I and others at FilmOn are a copyright owners. I have been involved in many films and television shows both as a performer, producer and distributor, including The Bank Job, Fishtales, MI5 and many more. FilmOn's personnel are made up of Film and TV Industry veterans. We produce exclusive content for FilmOn with pop culture celebrities like Andy Dick, Janice Dickinson and many more. We pay license fees to the NCAA, Arena Football League, Fashion TV and many more. We respect the sanctity of intellectual property."
FilmOn currently carries over 150 Linear streaming TV Channels for internet connected devices, many of which you will find on traditional cable as well as over 20,000 movies and TV shows On Demand. FilmOn was started in Europe in 2007 and was challenged by the European Networks, who failed to shutter services like FilmOn and today FilmOn enjoys a good working relationship with all Major European Networks.
