Specifically, this New York medical malpractice lawsuit was filed in Westchester County Supreme Court against the Westchester Medical Center after a child was born with severe injuries. The case was assigned a case number of A02206 and it was filed in an effort to recover damages for the injuries that were allegedly caused by the negligence of the defendant.
According to the court documents related to the case, the infant plaintiff was born at the defendant hospital at 27 weeks of gestation, weighing only 850 grams at birth. The mother did not have an eventful pregnancy to that point, as she had no health problems arise during those 27 weeks. However, the court documents stated that two weeks prior to the birth, the mother spent over a week in the hospital because of moderate pains and spotting before being discharged.
One week prior to the infant plaintiff's birth, the mother returned to the hospital where they told her that she had advanced cervical dilation. The court documents went on to state that the child was born via C-section because of non-reassuring fetal heart rate patterns and because of a vertex presentation. The child was rushed to NICU after birth.
The court documents then stated that five weeks later, it was determined that the child had contracted Group B streptococcus (GBS) and meningitis. The court documents allege that as a result, the child suffers from severe spastic quadriplegia with severe microcephaly and profound mental retardation and he will never be able to be self-reliant. The infant plaintiff will require ongoing care throughout his life and he will never be employable.
The New York medical malpractice lawyers at Fitzgerald & Fitzgerald argued in the pleadings that defendant hospital departed from good and accepted medical practice in the care of infant plaintiff in failing to diagnose and treat infant plaintiff's Group B streptococcus (GBS) and meningitis, which ultimately resulted in infant plaintiff sustaining severe and permanent injuries. The case ultimately settled for a sum of $4,098,273.00.
