"The most important thing to remember is that in Arizona any amount of alcohol consumption can result in a DUI charge if you get behind the wheel," says Lane. "Many people believe that if their blood alcohol content does not measure exactly .08 percent they cannot be charged, but this is not true. Arizona observes an 'impaired to the slightest degree' rule that can result in a charge even without a .08 BAC measurement."
"Therefore, the best way to avoid a DUI is to refrain from drinking if you are going to drive and refrain from driving if you are going to drink," says Lane. He also advises those who will be attending parties to make a designated driver plan before arriving at the party or plan to stay overnight. "Only time sobers you up when you have been drinking," says Lane.
For those who have been arrested for DUI, it is important to seek legal representation. "Trying to defend yourself in a DUI case is a very bad idea," says Lane. "You need the help of a defense attorney, even for your first DUI."
