The Complaint charges Allianz Dresdner Asset Management of America L.P., PIMCO Advisors Distributors LLC, Pacific Investment Management Company LLC, PEA Capital LLC, Pacific Company LLC, Edward J. Stern, Canary Capital Partners, LLC, Canary Investment Management, LLC and Canary Capital Partners, Ltd. (collectively "Canary") with violations of the Securities Act of 1933, the Securities Exchange Act of 1934, the Investment Company Act of 1940, and with common law breach of fiduciary duties.

Specifically, the Complaint alleges that during the Class Period the defendants engaged in illegal and improper trading practices, which caused financial injury to the shareholders of the PIMCO Mutual Funds. According to the Complaint, the Defendants surreptitiously permitted certain favored investors, including Canary, to illegally engage in "market timing" of the PIMCO Mutual Funds whereby these favored investors were permitted to conduct short-term, "in and out" trading of mutual fund shares, despite explicit restrictions on such activity in the PIMCO Mutual Funds' prospectuses.

If you purchased, held or redeemed the Funds during the Class Period and if you meet certain other legal requirements, you may file a motion in the court where the lawsuit has been filed to serve as a lead plaintiff. You must file your motion no later than April 20, 2004.

A lead plaintiff is a representative party that acts on behalf of other class members in directing the litigation. In order to be appointed lead plaintiff, the court must determine that the class member's claim is typical of the claims of other class members, and that the class member will adequately represent the class.
