The plaintiffs, who all reside in New York, were aboard the Crown Princess on July 18, 2006 when the ship departed from Canaveral, Florida for Brooklyn, New York. The victims suffered serious physical injuries after being violently thrown against the ship's decks and walls. The suit was filed in Superior Court of the State of California County of Los Angeles on July 27, 2006.

The Crown Princess is the newest passenger ship in Princess Cruise's fleet. The ship, which measures 952 feet in length and weighs approximately 113,000 tons, had more than 3,100 passengers and 1,200 crew members aboard when the incident occurred. The National Transportation Safety Board (NTSB) and Coast Guard have not yet concluded their investigation into the matter, but the president of Princess Cruises has said that the accident was a result of human error and not mechanical problems. Similar incidents involving the Crown Princess and other ships in the Princess fleet have occurred in the past.
