BOSTON, June 18, 2010 (GLOBE NEWSWIRE) -- Gilman and Pastor, LLP, a national law firm based in Boston, Massachusetts and Naples, Florida is representing consumers who have been the victims of appraisal and financial fraud, as well as construction of defective homes which include defective Chinese Drywall and other defects.
According to Gilman and Pastor, LLP, its clients include many victims of such fraud. Among these victims include Katrina Perez, who has lived a continuing nightmare over the last several years. According to the firm, she was first defrauded in connection with KB Home's and Countrywide's sales and marketing practices and mortgage and financing scheme. After her purchase, Mrs. Perez learned the hard way that KB Home does not resolve warranty claims with its homeowner customers in a reasonable manner. Despite a Federal Trade Commission Consent Order requiring KB Home to make timely warranty repairs and to furnish homeowners with comprehensive relief, KB Home faced subsequent charges that it had violated the FTC Consent Order. KB Home has continued to violate the legitimate basic rights and remedies of its homeowner customers according to Gilman and Pastor.
When Mrs. Perez attempted to receive coverage under her warranty, she learned that KB Home had closed many of its customer offices and disconnected the telephones in Florida. With nowhere to turn, Mrs. Perez turned to the national firm of Gilman and Pastor LLP to force KB Home to take responsibility for its actions. According to attorney, Kenneth G. Gilman, of Gilman and Pastor, KB Home refused to take any responsibility for the sales and marketing fraud, and their clients' homes containing defective Chinese drywall for years until Mr. Gilman forced the President and General Counsel to step up. Now, KB Home has promised to fully remediate and completely rebuild Mrs. Perez's home in Cape Coral, Florida and remove all of the defective drywall and remediate the home.
According to the Perezes, they and many other customers in Florida and nationwide were also the victims of a KB Home scheme, pursuant to which KB Home committed fraud in connection with the appraisal and setting of the purchase price for the home. KB Home formed a joint venture with Countrywide, now Bank of America, to unlawfully fix and manipulate the appraisal, sales price and financing of the home with two mortgages. But KB Home did not stop there. The house was seriously defective and contained major structural problems including as to the foundation and the use of defective Chinese drywall throughout the home. For several years, KB Home concealed this critical information from the Perezes. The Perezes and their child suffered daily from noxious sulfur odors, frequent headaches, inability to breathe properly and an inability to conceive a new child. In addition, they suffered severe property damage including corrosion of electrical and copper wiring, flooding, failure of air condition units and the complete lack of habitability in their home. According to the Perezes, it was unbearable. Now, Bank of America, formerly known as Countrywide (who engaged in a joint venture appraisal scheme with KB Home) is foreclosing on their home and seeking hundreds of thousands of dollars from the Perezes, notwithstanding all of the egregious acts of KB Home and Countrywide.
