Our investigation focuses on the extent to which KiOR issued false and misleading statements regarding its financial statement, past and future business performance and prospects. Specifically, KiOR failed to disclose that it lacked a reasonable basis for its projections as to total fuel production at its Columbus facility for the second quarter of 2013 and full fiscal year given manufacturing and start-up difficulties at the Columbus facility.
Since August 8, 2013, KiOR has fallen more than 40% after its announcement that it shipped a mere 75,000 gallons of fuel from its Columbus facility rather than its early projection for the facility of production of 300,000 gallons to 500,000 gallons. Revenue in the quarter was $239,000, about 12 percent of the $1.93 million average of five analysts' estimates compiled by Bloomberg.
