New York Birth Injury Lawyers at Fitzgerald & Fitzgerald Win $3,250,000.00 Jury Verdict

The lawsuit at issue here was filed in the New York County Supreme Court and it was assigned a case number of A02078. The case was filed against a local hospital and two of its practicing physicians. The lawsuit was filed in response to an allegedly negligent handling of the birth of the infant plaintiff who suffered permanent injuries that included global developmental delays, brain damage and right eye estropia. The claim sought damages for several different forms of loss suffered by the infant plaintiff who was named in the case.

According to the court documents associated with the matter, the plaintiff was born at the defendant hospital when his mother had reached 32 weeks of gestation via vaginal delivery. The mother had a troubled past with pregnancies including two miscarriages. The court documents stated that this controversy began one week before the infant plaintiff's birth when the mother reported to the hospital with vaginal bleeding. The next morning her water ruptured, and she was given an antibiotic and told to rest in bed. 

Six days later, the mother went into labor and she requested a vaginal birth. The court documents argued that the defendant doctors followed this request despite what were described as several warning signs of potential problems with the child. The child was born on the following morning and was suffering from infections from being exposed to toxins inside of the uterus after the membranes had leaked and the water had broken. 

As a result, the infant plaintiff suffered the permanent injuries described above and the attorneys at Fitzgerald & Fitzgerald successfully argued that the defendant hospital and its doctors failed to live up to the acceptable standards for medical practice in New York. The jury agreed and awarded the plaintiff a verdict of $3,250,000.00.
