A driver is suing the city of San Diego for failing to control crowds during the Zombie Walk, claiming this lack of control led to his injuries.

According to Mr. Gilleon, it is very possible that the city never issued a permit for the Zombie Walk, but still allowed it to take place. Under current San Diego statutes, groups that want to hold a parade or other large public gathering must have a permit on file so that the city can plan for disruptions to traffic and other problems that may result.
According to Gilleon, the driver in question claims that he was attacked by crowds attending the Zombie Walk. His windshield was punched out and his trunk was opened, at which point he decided to exit the vehicle. His nine-year-old child was sitting in the back seat at the time. When "zombies" tried to open the door next to the child, the man tried to move the car, at which time he accidentally ran over a woman.
The driver is suing the city of San Diego, according to Gilleon, not for the money but to bring attention to the fact that there was not proper control over the "Zombie Walk" and that this is the proximate cause of the woman's injuries. By suing the city of San Diego, Dan Gilleon hopes to exonerate his client from blame for hitting the woman and place the blame on the city for failing to require a permit or take action against the Zombie Walk organizers for allowing the dangerous conditions that led to this tragic crash.
