EnergySolutions Remains the Only U.S. Commercial Licensed and Operating Low-Level Waste Disposal Facility


SALT LAKE CITY, UT--(Marketwire - January 14, 2009) - EnergySolutions, Inc. (NYSE: ES), the only commercial licensed and operating low-level waste disposal facility in the United States, issued the following statement in response to numerous inquiries regarding the issuance of a conditional license by the Texas Commission on Environmental Quality (TCEQ) to WCS.

Today's action by the TCEQ granting a conditional license to WCS does not mean that the facility can dispose of waste in the foreseeable future. In fact, WCS must satisfy numerous conditions imposed by the commission before it can dispose of either commercial or federal waste. This will require extensive work. Some of these conditions are listed below:

--  Prior to accepting federal facility waste, WCS must receive an
    agreement signed by the U.S. Secretary of Energy assuming all right, title
    and interest in land and buildings for the disposal of federal facility
    waste
    
--  Complete Groundwater studies
    
--  Demonstrate that leachate from the landfill will not reach the
    Ogallala-Antlers-Gatuna Formation
    
--  Provide input parameters for predictive modeling
    
--  Demonstrate that buffer zones will remain unsaturated
    
--  Secure mineral rights on the proposed property
    
--  Finalize the design of the facility
    
--  Complete a site specific data assessment and management plan
    
--  Complete a performance assessment maintenance plan
    
--  Complete a fracture analysis plan
    
--  Complete a hydrogeologic properties report
    
--  Complete design verification
    
--  Conduct a particulate air emissions study
    
--  Install spill controls
    
--  Complete tracer studies to determine the proper location and
    installation of monitor wells in the Ogallala-Antlers-Gatuna Formation
    
--  Verify that salt dilution will not impact the disposal facility
    
--  Verify and evaluate local faults
    
--  Verify the adequacy of the leachate collection system
    
--  Develop an analysis of site specific erosion rates
    
--  Complete seismic stability studies
    

It will take a significant amount of time to satisfy all of these conditions. If the conditions are ever met, a small amount of commercial waste would be allowed for disposal from the states of Vermont and Texas, members of the Texas compact.
