EnergySolutions Pleased With Court's Ruling

SALT LAKE CITY, UT--(Marketwire - May 15, 2009) - EnergySolutions, Inc. (NYSE : ES )
announced today that the U.S. District Court for the District of Utah ruled
that the Northwest Compact lacks authority to restrict EnergySolutions'
receipt of waste generated outside the Compact region. In May 2008
EnergySolutions sought clarification from the court and today the court
agreed with the company's interpretation of the law on this critical issue.

thoroughness of Judge Stewart's decision in this case," said Steve Creamer,
CEO and Chairman of EnergySolutions. "Our Clive, Utah disposal facility is
a private commercial facility that is licensed by the State of Utah under
delegated authority by the Nuclear Regulatory Commission. We are pleased
that this ruling ends any question on this matter."
The Clive facility has been safely disposing of low-level material for over
20 years and has been disposing of residuals from internationally generated
material for more than eight years. The Northwest Compact has never voiced
an objection to the Clive facility's disposal of this material until
recently.
