The 12-page publication zeroes in on common misconceptions about litigation
holds that are frequently encountered within organizations that are failing
to implement reasonable and good faith efforts when it comes to executing
legal holds for discovery. Mr. Harris uses recent case law, particularly
experience throughout 2009 during a watershed year for legal hold findings,
to illuminate current best practices for legal hold notification and
compliance procedures. Some of the myths that he addresses include the
idea that requesting acknowledgments from custodians somehow adds risk,
that legal holds are for defendants only, and that "collecting everything"
eliminates the need to issue a legal hold notice.
Mr. Harris is an e-discovery expert who has focused on the area of legal
hold notification and compliance for the last five years, advising
organizations and presenting regularly on the topic. He is a frequent
author and speaker on e-discovery issues, including articles in Corporate

leading industry events such as Legal Tech New York.
