In her article, "Class Certification Statistical Analyses Post-Dukes," Dr. Baker examines the litigation environment following the Wal-Mart v. Dukes Supreme Court case in which current and former female Wal-Mart employees filed a class action lawsuit for discrimination. Analyzing the impact of this case, which the court rejected, from the perspective of a labor economist, Dr. Baker reveals the statistical approaches taken by the plaintiffs' experts and asks "what is the expert to do post-Dukes?" Dr. Baker also addresses the key issues of interest for attorneys, economists and courts as the use of statistical models evolves in future court rulings.
