The plaintiffs named in the case were the infant and the infant's parents as his adult guardians. The named defendant was the medical center where the infant child was delivered. The lawsuit sought several different forms of damages based on severe and permanent injuries suffered by the infant plaintiff that included cerebral palsy, mental retardation and a seizure disorder among others.
According to the court documents associated with the case, the plaintiff's mother reported to the defendant medical facility when she had reached 27 weeks of gestation. The documents also indicated that the mother had been through five previous pregnancies that had all resulted in miscarriages. The mother reported to the medical facility while experiencing contractions every 20 minutes. When she was admitted, she was given Tocolytic to stop labor and a drug to hasten lung development.
The court documents continued to describe the process, and they stated that the infant plaintiff was born three hours after the mother reported to the medical facility. The infant plaintiff weighed 1 pound and 15 ounces upon birth and he was intubated after being delivered via C-section. The infant plaintiff was subsequently kept in NICU for a period of several weeks until being discharged. Two weeks after being discharged, the infant plaintiff turned blue in the face while being fed and had to be resuscitated. At that point, the infant was diagnosed with gastric esophagal reflexbronchal pulmonary dysplasia, apnea and bradycardia.
