Specifically, the lawsuit was filed in the New York County Supreme Court against a defendant hospital and on behalf of an infant plaintiff and his parents. The case was assigned a case number of A00053 and it was filed in pursuit of several different forms of damages that were sought because the plaintiff was allegedly injured on a permanent basis because the defendant failed to detect premature labor and act on it in a timely manner.
According to the court documents associated with the case, the infant plaintiff's mother was 22 years old at the time of his birth and she had a history of two miscarriages that occurred at 32 weeks of gestation. When she had reached 29 weeks of gestation with this pregnancy, she reported to the defendant hospital complaining of abdominal pressure. No contractions were noted at that time and she was sent home.
Two days later, the mother began experiencing sharp abdominal pains and contacted the defendant hospital. She was allegedly told to take an over-the-counter medication and to relax. Three days later, the mother experienced contractions and reported to the defendant hospital. She was fully dilated and was sent to the operating room for the performance of a C-section. The court documents went on to state that during the birth, the mother's membranes ruptured which resulted in multiple infections for the infant plaintiff.
The court documents went on to state that the infant plaintiff was born with respiratory distress and other serious problems and that he was intubated and sent to NICU. He remained hospitalized for two months and was eventually diagnosed with brain damage, cerebral palsy and hypoxia among other medical problems.
