The firm hereby announces that it has settled a New York medical malpractice lawsuit against a local hospital and its doctors in the amount of $2,850,000.00.
Specifically, the lawsuit was filed in the Bronx County Supreme Court and it was assigned a case number of 89223A. The case was filed on behalf of an injured infant, hereinafter referred to as infant plaintiff, and the infant's mother. The case was filed against a local medical facility and different doctors at the facility and it sought several different forms of damages as a result of an alleged failure by the defendant and staff to properly advise the infant plaintiff's mother with regards to complications that she was experiencing prior to the infant plaintiff's birth.
According to the court documents, the plaintiff's mother called a defendant doctor when she was at approximately 25 weeks of gestation. She complained of spotting but was allegedly told that the doctor had guests and that she should not go to the hospital. Instead, the defendant doctor allegedly advised the plaintiff's mother to put her feet up and to come to see him on the following day. While she was at home before going to the hospital on the next day, the plaintiff's mother allegedly suffered ruptured membranes.
The plaintiff's mother was sent to the defendant hospital and gave birth to the infant plaintiff the following day, two days after initially calling one of the defendant doctors. Upon being born, according to the court documents, the infant plaintiff suffered from respiratory distress syndrome and he required oxygen therapy as a result. In addition, the court documents stated that as a result of the alleged failure to immediately treat the infant plaintiff's mother that the plaintiff suffered from Retrolental fibroplasias causing blindness, brain damage and eventually from cerebral palsy once it was diagnosed.
The attorneys at Fitzgerald & Fitzgerald contended that defendant doctor failed to treat the plaintiff's mother as a high-risk patient and admit her when she was spotting. Fitzgerald & Fitzgerald also argued that defendant doctor failed to prescribe bed rest and IV hydration, perform a cesarean section when there was fetal distress and manage a face presentation. Finally, the firm contended that once the infant plaintiff was born, the defendant hospital failed to properly monitor and administer oxygen therapy at appropriate therapeutic levels. Rather than send the matter to the jury, the case settled for $2,850,000.00.
