CINCINNATI, Sept. 30, 2014 (GLOBE NEWSWIRE) -- On December 5, 2013, the U.S. District Court for the Southern District of Illinois denied a motion to dismiss filed by the defendant, the Illinois Department of Healthcare and Family Services (the "Department"), in a class action case alleging that the Department failed to provide home or community-based mental health and behavioral services in the most integrated setting to Medicaid eligible children under the age of 21 as required by the Medicaid Act, the Americans with Disabilities Act and the Rehabilitation Act. (N.B., et al., v. Hamos, Case No. 11-cv-6866 (N.D. Ill.)). On February 13, 2014, the court certified a class of plaintiffs consisting of "all Medicaid-eligible children under the age of 21 in the State of Illinois: (1) who have been diagnosed with a mental health or behavioral disorder; and (2) for whom a licensed practitioner of the healing arts has recommended intensive home- and community-based services to correct or ameliorate their disorders."
